ENVIRONMENTAL

Licensing

Environmental licensing is an administrative process by which the government regulatory agency authorizes the location, installation, operation and expansion of enterprises, with the ultimate goal of promoting the sustainable development.

According to Federal Law No. 6.938 / 1981, which establishes the Environmental National Policy, it is required Environmental Licensing from all enterprises/ventures that have resource-using activities, considered as actually or potentially polluting, or those that in any form may cause environmental degradation.

ENVIRONMENTAL LICENSING

There are three types of licenses (preliminary license, installation license and operating license) which cover everything from planning to carrying out the regulated activity.

Preliminary License

The I.L must be obtained prior to the construction of the project, certifying that the completed project complies with the environmental legislation. I.L is requested by presenting the Basic Environmental Plan (PBA) or the Detailed Report of the Environmental Programs (RDPA), describing at the executive level, all environmental programs planned for the installation and operation phases of the activities.

Installation License

The I.L must be obtained prior to the construction of the project, certifying that the completed project complies with the environmental legislation. I.L is requested by presenting the Basic Environmental Plan (PBA) or the Detailed Report of the Environmental Programs (RDPA), describing at the executive level, all environmental programs planned for the installation and operation phases of the activities.

Operation License

O.L. must be obtained after the construction of the project and before starting the operation. It is the license which authorizes the operation of the proposed enterprise, and certifies that it was built in accordance with the project shown on the previous stages.

Conditions

In issuing environmental licenses, the public agencies establish conditions for the activities related to the enterprise (in the project phases, implementation and operation) cause as few environmental impacts as possible. Taken together, these conditions are known as condition factors and, if not complied with, the granted environmental license may be suspended.

Licensing agencies

Depending on how the project affects the environment, based mainly on the territorial scope of its impacts, different state environmental agencies can issue licenses:

IBAMA

The Brazilian Institute of Environment and Renewable Natural Resources conducts the licensing process in the federal sphere. In general, its environmental impact should exceed the territory of more than one state. Other cases in which it operates are projects that affect the Union asset’s or involves radioactivity.

States environmental agencies

These agencies are responsible for the environmental licensing when the foreseen impacts are distributed in more than one municipality, or when the activities affect the State assets.



Municipal environmental agencies

In general, they can issue licenses to activities whose impacts are restricted to its territory and shall have a Environment Council and qualified professionals. If these organs can not handle the scope of the proposed activities, licensing will take place at the state or federal level.

Other State Agencies

These agencies are invited to manifest during licensing processes, and may establish requirements for the responsible licensing agency to issue the desired environmental permits. Some examples are:



FUNAI

Indian National Foundation, intervenes when the venture impacts indigeneous communities, in demarcated land or not;




IPHAN

The National Institute of Artistic and Historical Heritage intervenes if the project affect the national cultural heritage, constituted by the material patrimony (archaeological findings, architectural works, historical areas, works of art) and immaterial patrimony (cultural activities, songs, folklore etc).



ICMBio

The Chico Mendes Institute of Preservation of Biodiversity operates in processes which impacts Conservation Units.



FCP

The Palmares Cultural Foundation may intervene when the project affects Quilombola Communities or their remnants
